The National Seminar on Human Rights Challenges to Medical Sector in India will be held at Government Law College, Ernakulam and conducted by the Centre for Medical Law in association with Chikithsa Neethi, Thrissur on 11th and 12th of January, 2019.

About Government Law College, Ernakulam

Government Law College, Ernakulam is affiliated to Mahatma Gandhi University, Kottayam and is a recognised research Centre in Law. The Centre for Medical Law is one such Centre which mainly focuses on legal aspects of law in medical sector.

About Chikithsa Neethi, Thrissur

Chikithsa Neethi is a charitable organization for protection of patient’s rights and to promote healthy relationship between doctors and patients. Chikithsa neethi helps the victims of medical negligence by analysing the medical and legal side of each case and give advice accordingly. We have an advisory body of eminent social activists, legal experts and doctors.

About the Seminar

Human Rights are fundamental rights to which a person is inherently entitled to, simply because she or he is a human being. It is universal in application. India has incorporated human right protection into the legal framework.

Medical Law is used to protect human rights by regulating Professional Conduct. Doctor-Patient relationship, a fiduciary relationship has now changed to the patient as a consumer and doctor as a provider of service. Paternalism (Doctor Knows Best) has changed to Patient’s Rights Approach in which Provider’s rights are not taken into account.

Health Law deals with the interaction between State and citizens regarding their health. The state has a duty to ensure that reasonable restrictions in the exercise of patient’s rights shall be interpreted strictly and is not exercised in a discriminatory and arbitrary manner.

The concept of ‘HUMAN RIGHTS IN PATIENT CARE’ refers to the application of human rights principles to the context of patient care. Patient care refers to the prevention, treatment and management of illness and the preservation of physical and mental well – being through services offered by a health professional.

Human Rights in patient care addresses individual and community health and makes accountable all the stakeholders involved in the health delivery. Human Rights in patient care is a gap – building approach to medical law and health law.

The purpose of this seminar is to persuade the government to frame laws, policies and guidelines to protect the human rights of patients and providers, monitoring of abuses within health care services and to legally address them.

Guidelines for submission

The abstract can be submitted electronically via e-mail to centreformedicallawglcekm@gmail.com on or before 26/12/2018.

The abstract and final paper submitted shall undergo an internal review process and the acceptance of the paper shall be communicated through the email.

Registration

Registration can be done on 11th  January 2019 on spot and the Registration fee is Rs. 500/person.
