About the Webinar
While it was widely contested whether the SC in the “Sabarimala” case had the mandate to interpret religious practices, the judges held that irrespective of a religious practice being essential or not, the constitutional values will and should prevail over essential and certain aspects of religion.
The Review applications in “Kantaru Rajeevaru v. IYLA” case are pending before the nine-judge bench of the Supreme Court. Tentative issued will be broadly framed on, inter alia;
- Interplay of Art. 25 & 26 with Part III of the Constitution (especially Art. 14)
- Extent of “public order, morality & health” in Art. 15(1)
- Contours of “Constitutional morality”
- Extent of the prevalence of judicial review of religion
