About Bachpan Bachao Andolan
Bachpan Bachao Andolan is an India-based movement campaigning for the rights of children. It was started in 1980 by Nobel Laureate Mr. Kailash Satyarthi. Its focus has centered on ending bonded labor, child labor, and human trafficking, as well as demanding the right to education for all children.
Job Roles and Responsibilities
Pre-trial
Ability to handle and conduct the pre-trial stage in a professional manner, including, but not limited to victim assistance in interim compensation, filing of the case, etc.
The detailed responsibilities shall include the following:
- Helping the victim in drafting the complaint
- To assist the victim in filing the case
- Obtaining a copy of FIR
- Obtaining the contact details of Investigating Officer, the victim, and his family members
- Getting the Vakalatnama from the parents of the prosecutrix/victim
- Assistance for the recording of statements under Section 164 of Cr. P.C
- To assist the victim in obtaining the immediate and interim compensation by filing application before (DLSA/Special Courts/CWC etc.)
- Opposing the bail application filed by the accused
- Follow up with Inspecting Officer for filing of the charge sheet
Trial onwards
The candidate should be able to represent the client at arraignments, hearings, and court trials. He/she should also possess the ability to present evidence before the judge if the case goes to trial.
The detailed responsibilities should also involve the following:
- To collect the case papers to the extent possible. Conduct research, analysis of the legal issues and the applicable statute involved therein. Ability to assess/identify the legal defect/loopholes in the case prepared by the police and take steps to get the same rectified
- To counsel and build the confidence of the victim in warding off threats/inducements
- Filing a complaint to the Police and the witness protection committee
- Examine the case and interview the witnesses
- To maintain constant communication with the victim
- To oppose the bail application and in case of bail granted, to approach the High Court
- Ability to coordinate with; and monitor all stakeholders
- To ensure payment of Diet money to the witness by the court
Experience and Qualifications Required
Qualification
- Bachelor’s degree in Law
Experience
- Minimum 5 years of experience preferably in Criminal Law practice
- Experience in drafting, negotiating, and reviewing legal documents
Skills and Competencies Required
- Strong analytical skills and excellent attention to detail
- Decision-making and problem-solving skills
- Good analytical skills and powerful creative thinking so that a better legal strategy could be developed
in-depth understanding of the local rules, procedures of the court, evidentiary laws, and local judiciaries so that the criminal justice system could be resourcefully and proficiently navigated - Ability to work independently, under pressure, and meet deadlines
outstanding oral and written advocacy skills so that they can argue a client’s case beforehand the judge and convince the court - Determined, professional, and well informed with a keen interest in upholding the law
- Ability to interpret laws for clients and help them to understand their legal options
- Ability to conduct in an ethical and professional manner at all times
- Be abreast with applicable laws and amendments thereto
