Call for Papers: Book on Indian Copyright and Trademarks: Submit by April 7

It is a pleasure to inform you that we are going to publish one edited volume on the Indian Copyright and Trademarks (with ISBN, to be published by publisher of repute).

Concept Note:

The copyright and trademarks laws work in two different fields. But there exists connectivity between them through the bridge of art and culture.

The Indian Copyright Law protects the author’s right over the literary, dramatic, musical and artistic works, cinematograph films and sound-recording, whereas the Trademarks law protect the rights of a proprietor of a trademark (whether registered or unregistered).

Though the trademarks are related to trade and business a strong relation between creativity, art and trademarks is in existence.

The existing Copyright Act of India has been enacted in 1957 and the predecessor of the present Trademarks Act of 1999 (i.e., Trade and Merchandise Marks Act, 1958) was enacted in 1958. Both the laws had undergone major amendments during these 60 years (1957/58-2017).

So this prolonged period calls for reappraisal, rethinking and review of the copyright and trademark laws of India.

Academicians, lawyers, research scholars and students are invited to contribute.


Art, Culture and the Law: A Visit to the Field of Copyright and Trademark Protection


The papers should focus on the following sub-themes:

i. The concept of copyright in ancient India and its effects,

ii. The Doctrine of First Sale in Copyright Laws,

iii. You-tube and the Doctrine of Fair Use,

iv. Search Engines and Copyright Law,

v. Fusion, Remake and Remix: Extent of the Degree of Innovation in Copyright Law,

vi. Emerging trend in Digital Copyright and the Law,

vii. Copyright in logos and designs,

viii. Trade dress protection: An analysis,

ix. Intellectual Property and Competition Policy,

x. Comparative advertisement and trademark,

xi. Secondary meaning in trademark law,

xii. Culture, Customary Marks and Trademark Protection, and

Any other contemporary issue related to Copyright and Trademark laws.

Submission Guidelines:

i. Please send the paper in MS Word format.

The paper should contain a proper title (subtitle is also allowed), an abstract (within 300 words), key-words (maximum five), author’s name, designation, residential address, e-mail address and phone number.

The manuscript should be in English (British English).

ii. The paper should be original and unpublished, free from grammatical, spelling and other errors.

Papers plagiarised and infringing the copyright of other works will be subject to rejection.

The contributors are asked to send declarations to that effect. The declaration should be sent as a separate document (in MS Word format).

iii. Paper Size: A4; Font Type and Size: Times New Roman, 12 (for the main body) and 10 (for footnotes); Line Spacing: 1.5 (for the main body) and 1.0 (for footnotes); Margin: 2 cm on all four sides. No page border should be used.

iv. Word limit: i) Articles: 8,000-15,000(including footnotes but excluding bibliography), ii) Book Reviews 3000-5000 (including footnotes but excluding) iii) Case Comments, Notes: 2000-4000 (including footnotes but excluding).

v. References and Citation style: Footnotes should be acceptable and not the end-notes. The paper should contain a bibliography at the end.

For citation and bibliography OSCOLA style (4th edn) should be followed.

vi. All papers are subject to review. Contributors will be informed about the status of their paper within 2 months from the date of submission.

Rejected papers won’t be sent back to the contributors.

The editors reserve the right to make any modifications in the paper accepted if it not in harmony with the standards mentioned in the guidelines.
